Terms for Renter

These user terms are an agreement between Hyre ApS, as the service provider, and the users of Hyre’s services. The agreement regulates your rights and obligations as a user of Hyre’s services, as well as Hyre’s rights and obligations as the provider of the service. By using Hyre’s services, you accept the user terms in force at any given time. We encourage you to carefully read and familiarize yourself with these terms, including the privacy policy.

Introduction

The applicable terms will always be available on Hyre’s website and in the Hyre app. “User/renter” refers to the natural or legal person registered as the renter of a Hyre vehicle. These terms govern the use of Hyre’s services and thereby the relationship between the “user/renter” and “Hyre.” The user undertakes to comply with all applicable provisions and terms at all times. All users must be familiar with these terms and are obligated to follow them in accordance with this agreement.

2. The Renter’s Duties and Responsibilities

2.1 Registration and approval

Hyre is a service designed to make it easy for businesses and private individuals to rent a car.

When creating a profile with Hyre, you agree to provide correct, updated, truthful, and complete information as requested during registration. You also undertake to continuously maintain and update your contact information and inform Hyre about matters that may be relevant to Hyre or the fulfillment of the terms of the agreement – including, but not limited to, information about driving privileges, traffic violations, accidents, and the condition of the car.

Failure to provide or maintain correct information is considered a material breach of the user terms and gives Hyre the right to close your profile with immediate effect.

Hyre’s collection, storage, and processing of personal data in connection with profile creation and use of the services is described in Hyre’s privacy policy.

You may terminate your profile with Hyre at any time. Termination takes effect immediately when you actively deregister – either via email to hej@hyre.dk or directly in the app. Previous information and rights cannot be restored upon new registration.

Hyre reserves the right to reject applications for profile creation without further explanation.

To rent a car through Hyre, you must meet the following requirements:

  • Be at least 18 years old
  • Hold a valid category B driving license

It is not permitted to create more than one profile per person or to create profiles with different MitID identities. A Hyre profile is personal and cannot be transferred. Hyre reserves the right to fully or partially transfer its rights and obligations to another company. In such cases, you will be given reasonable notice.

All users are required to protect their login information and other sensitive data to prevent misuse.

2.2 Treatment and use of the vehicle

The renter undertakes to comply with all applicable rules and terms for using Hyre. You are responsible for following traffic laws and checking lights, brakes, seat belts, tires, air pressure, etc. before using the car. You must ensure that the car remains in good and legal condition throughout the rental period.

The renter must treat the vehicle properly and may not:

  • Smoke in the car
  • Use the car for racing, speed tests, test driving, or competitions
  • Charge passengers for transportation
  • Use the car for illegal or criminal purposes
  • Allow anyone other than approved drivers to operate the car
  • Tow, push, or move other vehicles
  • Leave the car unlocked or in a way that allows others to take it
  • Use incorrect fuel
  • Transport animals unless specifically agreed with Hyre
  • Drive under the influence of alcohol, drugs, or other illegal substances
  • Start the car with jumper cables (except with roadside assistance), or use it to start other cars

Damages arising from violations of these rules are the renter’s responsibility. Hyre is entitled to full compensation for financial losses. Violations are considered material breaches, and Hyre may terminate your account immediately. The renter is fully responsible for the car until it is correctly returned – unless the fault lies with Hyre.

Driving practice (learner driving) is permitted in all passenger cars. The user must ensure that the car is suitable and that the driving is conducted safely.

2.3 Prices and payment

Hyre’s current prices are stated in the Hyre app and form an integral part of this agreement. All prices include VAT unless otherwise stated.

The renter covers all costs associated with the rental, including rental price, road tolls, extra mileage, fuel costs, parking fees, and any other expenses incurred during the rental period.

Hyre may charge the full rental amount at the time of booking before the rental period starts. A deposit of DKK 1,000 is reserved when selecting “Reserve.” When choosing “Drive Now,” a deposit of DKK 2,000 is reserved as security for payment of the rental, extra kilometers, tolls, and fuel. The deposit is released after the car is returned. It may take up to 7 business days after return for the money to be available to the renter again.

Hyre may charge ongoing payments during the rental period. Rental fees, tolls, extra kilometers, and fuel costs are usually charged to the card on the same day the rental ends, but can be adjusted later if errors are discovered. After the rental period, Hyre may charge the card for costs the renter is responsible for. Hyre will always strive to charge all associated costs within 30 days of rental end, but unpaid fines and parking fees can be charged up to 6 months afterward.

Hyre may charge the renter additionally for:

  • Agreed rental price plus extra kilometers, insurance, tolls, and fuel
  • Costs for home transport due to misuse or returning the car to the wrong location, collection fees, and interest charges
  • Fines, parking fees, unpaid toll fees, and similar fees/charges where the vehicle owner is jointly liable with the driver
  • Cleaning, washing, repairs, and maintenance resulting from damage or breach of terms. This includes all internal and external administrative or case-handling fees and transportation or handling costs such as invoicing fees and costs related to moving the vehicle or damage assessment. If the vehicle is unavailable for rental due to damage or repair, the renter’s responsibility also includes lost rental income according to compensation rules
  • Fees for not plugging in an electric vehicle for charging. The renter must ensure the electric vehicle is charged upon return; otherwise, a fee applies according to the current price list

Additional charges are automatically deducted from the renter’s registered payment card. If this is not possible, Hyre will invoice the outstanding amount. In that case, an invoice fee and administrative fee will apply according to Hyre’s current rates.

If payment is not made, the renter’s account will be closed, and if payment remains outstanding after repeated reminders, future bookings will be canceled. Outstanding claims will be sent to debt collection after prior notice.

2.4 Duration of Rental Agreement

The renter must return the vehicle as specified in the booking and before the return deadline. The return is considered complete when the vehicle is locked, the rental is ended in the app, and photos of all sides of the vehicle are taken and submitted via the app.

The car must be parked in a parking space that matches the parking information for the specific vehicle. Parking must be legal for at least 24 hours from the end of the rental agreement. If parking at the designated location is unavailable, Hyre must be contacted immediately for instructions on where to leave the vehicle.

Leaving the vehicle outside the designated area without Hyre’s consent is at the renter’s own risk, and the renter is responsible for costs and fees according to Hyre’s current prices for returns outside the pickup area.

Vehicles may only be used within the reserved time period. Using the vehicle without a valid reservation—for example, late return—will incur fees in addition to the cost of the extended rental period, based on current prices.

2.5 Termination

If these terms are breached, or if Hyre considers it likely that violations of terms or laws have occurred that could harm Hyre, Hyre may terminate your profile with immediate effect. The renter will normally be notified but prior notice is not a requirement for termination. The renter can also delete their account in the Hyre app at any time.

Termination takes effect from the time it is given. The renter remains obligated to pay any outstanding amounts existing at termination time, as well as any amounts incurred after termination. Any reservation on the renter’s payment card will be released no later than 7 banking days after valid return (unless Hyre has previously charged or settled the amount).

Any existing bookings at termination time are automatically canceled simultaneously without the renter having any claim against Hyre.

3. Damage, Theft, Fault or Defect of the Vehicle

The renter is responsible for all damages, theft, and third-party liabilities that occur during the rental period.

3.1 Definitions

A defect exists if the vehicle provided by Hyre deviates from the agreement with the renter. Examples include technical faults with the vehicle or reservation, the vehicle needing immediate service or repair, damage at the start of the reservation, or the vehicle being so dirty that it cannot be used.

A delay exists if the vehicle or an equivalent vehicle is not made available to the renter at the agreed time.

An obstruction includes defects, delays, and other damage, faults, or unforeseen events related to Hyre’s vehicle or systems that affect the renter’s ability to complete the reservation. For example, if the vehicle is not at the agreed location, has starting problems, or the renter becomes stuck.

3.2 Damage inspection and duty to investigate

The renter must always check the car externally for damages and other faults or defects and take pictures of all sides before pickup and after return.

The renter must also check the vehicle’s interior condition at pickup and return and report any discrepancies including damage, dirt, trash, missing or defective equipment, odors, and other conditions affecting the car’s condition. Photos must be taken of all reported issues that are visible in images.

If unsure whether the condition should be reported, the renter must contact Hyre customer service before leaving the parking lot with the car.

The renter is responsible for ensuring photo documentation is of sufficient quality to document any damages, scratches, and defects before and after rental. Documentation is necessary to complete the rental (see 2.4 Duration of Rental Agreement). Failure to document is at the renter’s own risk and is considered a material breach, allowing Hyre to terminate the profile immediately. The renter is responsible for damages discovered after rental that were not documented before the rental started.

By taking photos/videos for damage inspection at pickup and return, you grant Hyre a non-exclusive, transferable right to use, modify, publish, reproduce, distribute, and share this content with third parties.

3.3 Hyre’s Mobility Guarantee

If an obstacle occurs, Hyre will, as far as possible, assist with resolution and repair in accordance with this section.

  • On-site Assistance
    • In the event of an obstacle, Hyre will, as far as possible, provide assistance to the renter through remote guidance and support. If on-site assistance is needed, Hyre will arrange roadside assistance within a reasonable time.
  • Replacement Vehicle
    • If the obstacle cannot be resolved on-site within a reasonable time—considering the reservation duration and purpose—Hyre will, as far as possible, offer a replacement vehicle. Hyre is free to provide a replacement vehicle from its own fleet or a professional third party.
    • Hyre will cover the renter’s reasonable and necessary expenses for transport to the replacement vehicle and the rental cost of the replacement vehicle. The renter will be responsible for the rental time and hourly rate related to the entire reservation period for the original vehicle. Furthermore, the renter is responsible for fuel, road tolls, fines, fees, and any damages to the replacement vehicle, as well as other costs normally not covered by Hyre.
  • Alternative Transport
    As an alternative to a replacement vehicle, the renter may choose:
    • To wait for repair of the originally rented vehicle. Hyre will cover reasonable and necessary accommodation for up to four nights, and the renter will be reimbursed for the downtime of the vehicle.
    • Further transport by public transportation or taxi up to NOK 2,000.

3.4 Liability and Rights in Case of Breach

  • Price Reduction:
    The renter may claim a price reduction if the defect is not remedied or resolved within a reasonable time in accordance with Hyre’s mobility guarantee. The price reduction shall correspond to a reduction in the rental price for the period during which the renter was prevented from using the vehicle. Similarly, the renter may claim a price reduction if there is a delay and Hyre does not resolve the delay within a reasonable time as per the mobility guarantee. The price reduction shall correspond to the rental price for the duration of the delay.
  • Termination:
    Instead of a price reduction, the renter may terminate the remaining reservation if the defect or delay is substantial. A defect or delay is substantial if it means the renter cannot use the reservation for its intended purpose. Termination requires that Hyre has been given reasonable opportunity to remedy the defect or delay in accordance with the mobility guarantee.
  • Compensation:
    If Hyre does not remedy the defect or delay within a reasonable time according to the mobility guarantee, the renter may claim compensation for reasonable and necessary direct losses suffered. Hyre’s liability for compensation is in all cases limited to an amount equivalent to the original rental period of the relevant reservation.

Hyre’s liability requires that the renter reasonably limits their financial losses.

Liability is limited to losses that Hyre could reasonably have foreseen as a possible consequence of the breach.

Hyre is not liable for compensation if Hyre can prove that the defect or delay was caused by circumstances beyond Hyre’s control.

Complaint:
The renter loses their rights to price reduction, termination, or compensation if they do not notify Hyre of the defect immediately after it is discovered or should have been discovered. In case of delay, the renter loses their rights if they do not immediately inform Hyre that the vehicle was not made available as agreed.

3.5 Limitations of Hyre’s Liability

Hyre is not liable under Hyre’s mobility guarantee if the obstruction, defect, or delay is caused by the renter’s gross negligence or intentional actions, or if the renter has violated these terms of use. In such cases, Hyre may invoice the renter for Hyre’s expenses.

Hyre is not liable for third-party losses.

Hyre is not liable for lost income, loss of interest, indirect damages, or consequential damages such as production stoppages or lost profits.

Hyre assumes no responsibility for damage to or loss of property that the renter or any other person has left, stored, or transported in the vehicle during the rental period or after return. The renter waives the right to make claims against Hyre for such losses or damages. Hyre is not responsible for loss of time, money, or other losses related to the rental beyond what is described in this agreement.

The renter cannot claim compensation for indirect losses — for example, operational losses, deprivation, lost profits due to improper fulfillment of the rental agreement, or damage to things other than the rental vehicle — unless Hyre has acted with gross negligence or intent.

Hyre is not responsible for the content, material, or other information appearing on third-party websites linked to or from Hyre.

4. Insurance and Deductible

4.1 Coverage and Deductible

The deductible for damage is set according to the applicable insurance agreement.

In case of damage, theft, fire, or personal injury, the police must be notified immediately. In case of collision with animals, the police or animal control center must be informed.

Damage reports must be created directly in the Hyre app and must be completed and submitted immediately before ending the booking. Failure to report damage or delay in reporting may result in the insurance not covering the damage, and the renter will be responsible for losses and additional costs.

Hyre may invoice for damages and deductibles even during disputes or claims against third parties. The renter may not withhold payment for alleged counterclaims without Hyre’s consent.

4.2 Higher Insurance Premium for Young Drivers

An additional insurance fee applies for customers under 23 years old. The age of your youngest driver determines the surcharge on rental time and extra kilometers.

Age limits and surcharges are as follows:

  • 22 years: 6%
  • 21 years: 8%
  • 20 years: 10%
  • 19 years: 16%
  • 18 years: 20%

4.3 Exceptions from Coverage

The renter covers the following themselves:

  • Roadside assistance for empty tank, wrong fuel, lost key, dead battery, etc.
  • Repairs and cleaning resulting from misuse of the vehicle
  • Damage and liability arising from negligent use or use in violation of the law or Hyre’s terms. In cases of negligent or irresponsible use, Hyre’s mobility guarantee lapses.

This includes, for example:

  • Use in racing or competitions
  • Use off-road or in unauthorized areas
  • Use for illegal purposes
  • Driving in countries outside the permitted areas
  • Use by persons not registered in the reservation
  • Leaving the vehicle unlocked
  • Starting the vehicle with jumper cables (except during roadside assistance) or using the vehicle to start other vehicles
  • Smoking in the vehicle
  • Use of wrong fuel
  • Leaving the vehicle with the engine running or windows open

Ownership of Hyre’s Vehicles

The vehicles are owned by Hyre’s financing company, which leases the vehicles to Hyre. If the leasing agreement between Hyre and the financing company terminates, the financing company is entitled to demand that this rental contract is terminated. In such a case, Hyre will disclose the renter’s contact details, including name, address, and email, to the financing company. The legal basis for such disclosure follows the GDPR Article 6(1)(f) (balance of interests). Hyre’s vehicles are financed via one of the following leasing companies: Autolease, Opendo, Nordania, or Santander.

6. Fee Adjustments

Hyre may increase existing fees and/or introduce new fees if the increase/new fee is due to income-related, market-related, cost-related, or regulatory reasons. Examples include:

  • General increase in cost levels
  • Increased costs to external suppliers
  • Changes in laws, case law, or administrative practices that increase expenses or reduce income for Hyre
  • Changes related to the basis on which the renter’s individual fee terms were previously set
  • More efficient use of Hyre’s resources or capacity, for example, encouraging the use of certain solutions

The list is not exhaustive.

7. Right of Withdrawal

There is no right of withdrawal for renting cars via Hyre’s platform (Hyre app). However, under certain circumstances, Hyre grants the renter the right to cancel an order, possibly subject to a cancellation fee, cf. the Terms for prices, fees, and rules for expenses. The right of withdrawal for subscriptions is covered in section 6 regarding Hyre Pass.

8. Force Majeure

Hyre is not responsible for failure or delay in delivery if caused by circumstances beyond Hyre’s control, which Hyre could not reasonably have foreseen, avoided, or overcome.

Force majeure includes, but is not limited to, strikes, fire, war, confiscation, currency restrictions, riots and unrest, lack of transport, general shortage of goods, power outages, telecommunications or internet failures, epidemics, pandemics, or delayed/refused delivery from subcontractors.

9. Changes to Terms of Use

Hyre reserves the right to change the terms of use with reasonable notice. Renters will be notified of changes by email and/or through the app.

Continued use of the service after changes have taken effect is considered acceptance of the new terms.

If you do not accept the changes, you must stop using the service, and your profile will be closed. Any active reservations may be canceled by Hyre.

10. Breach of Contract

The agreement is considered breached if the renter does not comply with the terms.

11. Use of Location Data

Vehicles are equipped with GPS that can record position, speed, and driving patterns. In case of damage or insurance claims, Hyre reserves the right to use this data and share it with relevant authorities.

12. Complaint Procedure

As a car rental company, Hyre is subject to consumer complaint procedures.

Complaints can be submitted electronically to the Consumer Complaints Board at www.naevneneshus.dk.

There is a fee of DKK 100 to submit a complaint. Before filing a complaint, the renter must have unsuccessfully tried to resolve the issue directly with Hyre. If no agreement is reached through the Consumer Complaints Board, the renter may bring the case to the Consumer Complaints Tribunal within 4 weeks. The fee for the Consumer Complaints Tribunal is DKK 400, which will be refunded if the renter wins or if the complaint cannot be processed.

14. Commission to Partners

Hyre may receive or pay commissions or other remuneration when purchasing or mediating products from partners.

15. No Guarantee Fund or Scheme

There is no guarantee fund or scheme for this agreement.
